These Terms of Use (“Terms”) govern your access to and use of VIXI: AI Video & Photo (“VIXI,” “we,” “our,” or “us”), package name com.vixi.video. By downloading, accessing, or using VIXI, you agree to these Terms. If you do not agree, do not use the app.
1. The Service
VIXI provides AI-assisted tools that may allow users to generate, edit, and explore images and videos using media, text prompts, instructions, style choices, and other inputs. Features, availability, limits, and results may change over time. We may modify, suspend, or discontinue all or part of the service as permitted by law.
2. Eligibility and Lawful Use
You may use VIXI only if you are legally able to agree to these Terms and your use is permitted under applicable law. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms when required.
3. Your Inputs, Outputs, and Responsibility
“Inputs” include photos, videos, prompts, instructions, selections, and other material you submit or make available to VIXI. “Outputs” include generated or edited images, videos, and other results returned by the service.
You retain any rights you have in your Inputs. You grant us a limited, non-exclusive, worldwide license to host, reproduce, transmit, modify, and process Inputs only as reasonably necessary to operate, secure, and provide the requested service, comply with law, and enforce these Terms.
As between you and VIXI, and to the extent permitted by applicable law, we do not claim ownership of your Outputs. Laws governing AI-generated content vary, and an Output may not qualify for intellectual-property protection.
You are responsible for your Inputs, your Outputs, and any way you use, publish, distribute, represent, or rely on them. You must review Outputs before use and obtain all permissions, licenses, releases, or consents required for your Inputs and intended use. Similar or identical results may be generated for other users.
4. Prohibited Conduct and Content
You may not use VIXI to create, upload, request, edit, publish, share, or facilitate content or conduct that:
- violates any law, regulation, court order, or legal duty;
- infringes or misappropriates copyright, trademark, privacy, publicity, confidentiality, or other rights;
- uses another person’s likeness, voice, identity, or personal information without necessary rights or consent;
- is fraudulent, deceptive, defamatory, harassing, threatening, exploitative, or intended to impersonate or harm another person;
- is unlawful or materially misleading, including manipulated media presented as authentic to deceive others;
- depicts or facilitates child sexual abuse or exploitation, non-consensual intimate imagery, sexual violence, or other illegal sexual content;
- promotes violence, illegal activity, malware, unauthorized access, or evasion of safeguards;
- interferes with, overloads, probes, damages, or attempts to bypass the security or operation of VIXI; or
- uses automated means to extract data or access the service except where we expressly permit it.
We may block requests, remove access, preserve relevant information, or report matters to appropriate authorities where reasonably necessary to prevent harm, enforce these Terms, or comply with law.
5. AI Output Disclaimer
VIXI uses automated systems. Outputs may be inaccurate, incomplete, offensive, unexpected, unrealistic, or similar to existing material. VIXI does not verify that an Output is original, lawful, accurate, non-infringing, or suitable for your purpose.
Do not rely on VIXI as a source of professional, medical, legal, financial, or other expert advice. You are responsible for appropriate human review and for clearly disclosing AI-generated or materially altered content where law, platform rules, context, or responsible practice requires it.
6. Intellectual Property in VIXI
VIXI, including its software, interface, branding, visual design, and associated technology, is owned by us or our licensors and is protected by applicable laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the app for its intended purposes.
You may not copy, sell, sublicense, reverse engineer, decompile, modify, distribute, or create derivative works from VIXI except to the extent such a restriction is prohibited by law.
7. Paid Features, Purchases, and Subscriptions
VIXI may offer paid features, in-app purchases, or automatically renewing subscriptions through Google Play. If offered, the price, billing interval, trial terms, and included features will be shown before purchase. Payments and billing are handled by Google Play under the terms associated with your Google Play account.
If you start an automatically renewing subscription, it may renew unless canceled before the applicable renewal time. You can manage or cancel it through your Google Play account settings. Refund eligibility is determined by applicable law and Google Play policies. Deleting VIXI does not itself cancel a subscription.
8. Third-Party Services
VIXI may use or link to third-party services. Their products, content, availability, and practices are governed by their own terms and policies. We are not responsible for third-party services to the extent permitted by law.
9. Suspension and Termination
You may stop using VIXI at any time. We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or harm, misused the service, failed to pay applicable charges, or if action is required for security, operational, or legal reasons.
Sections that by their nature should continue—including provisions about responsibility, intellectual property, disclaimers, liability, and disputes—survive termination.
10. Service Availability and Disclaimer
To the maximum extent permitted by law, VIXI is provided “as is” and “as available.” We disclaim express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of Liability
To the maximum extent permitted by law, VIXI and its owners, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, content, or opportunities arising from or related to the service, Inputs, Outputs, or these Terms.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless VIXI and its owners, affiliates, licensors, and service providers from claims, losses, liabilities, and reasonable expenses arising from your Inputs, Outputs, publication or use of content, violation of these Terms, or infringement of another person’s rights.
13. Changes to These Terms
We may revise these Terms to reflect changes to VIXI, legal requirements, or business practices. We will post the revised Terms and update the “Last Updated” date. Where required, we will provide additional notice. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
14. Governing Law and General Terms
These Terms are governed by applicable law, without overriding mandatory consumer protections available where you live. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or transfer of the service.
